 <strong>RGPD <\/strong>&#8220;) and Law no. 78-17 of January 6, 1978 as amended, known as the &#8220;Loi informatique et libert\u00e9s&#8221; (hereinafter &#8221; <strong>Law no. 78-17<\/strong> &#8220;).<\/p>\n<p>As part of its business activities, <strong>RESEAU DEF<\/strong>a limited liability company with share capital of 20,976,137.80 euros, headquartered at Parc d&#8217;activit\u00e9s du moulin de Massy, 7 rue du saule trapu &#8211; 91300 Massy, registered with the Evry Trade and Companies Registry under number 340 087 576, and all its entities within the meaning of article L. 233-1 of the French Commercial Code (hereinafter referred to as the &#8220;Group&#8221;).  <strong>R\u00e9seau DEF<\/strong> &#8220;) collect and process on their behalf the personal data of their customers, prospects, subcontractors, service providers or various partners (hereinafter generally referred to as &#8221; Legal basis for processing<span class=\"toggle_icon\"><span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p><div id='toggle-id-3' aria-labelledby='toggle-toggle-id-3' role='region' class='toggle_wrap  av-title-above'  ><div class='toggle_content invers-color '  itemprop=\"text\" ><p>In accordance with applicable legislation on the protection of personal data, the processing of personal data by R\u00e9seau DEF has a legal basis.<\/p>\n<p>R\u00e9seau DEF processes the Customer&#8217;s personal data provided that the Customer :<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>(i) has entered into a contract for the provision of services and\/or the purchase of products ;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>(ii) has completed an electronic collection form in order to participate in an event organized by the DEF Network;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>(iii) has registered or subscribed to services made available online by the DEF Network (e.g., website, social networks, YouTube channel); and\/or<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>(iv) that the Customer&#8217;s express consent has been obtained (e.g. deposit of cookies on the Customer&#8217;s navigation terminal when visiting an Internet site published by R\u00e9seau DEF).<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/section>\n<section class='av_toggle_section av-ldk8zwfk-b64749e4799ec251e98f31e91f35b2ef'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  ><p id='toggle-toggle-id-4' data-fake-id='#toggle-id-4' class='toggler  av-title-above '  itemprop=\"headline\"  role='tab' tabindex='0' aria-controls='toggle-id-4' data-slide-speed=\"200\" data-title=\"Article 4. Types of personal data collected<span class=\"toggle_icon\"><span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p><div id='toggle-id-4' aria-labelledby='toggle-toggle-id-4' role='region' class='toggle_wrap  av-title-above'  ><div class='toggle_content invers-color '  itemprop=\"text\" ><p>R\u00e9seau DEF collects and processes the personal data that the Customer voluntarily communicates to it either by means of a collection form or when concluding a contract for the provision of services and\/or the acquisition of products.<\/p>\n<p>Customers are informed on each personal data collection form of the compulsory or optional nature of their answers by the presence of an asterisk.<\/p>\n<p>Where answers are compulsory, DEF explains the consequences of not answering.<\/p>\n<p>The personal data collected in this context are as follows:<\/p>\n<p>NON TECHNICAL DATA (depending on use) :<\/p>\n<ul>\n<li>(i) Identification: surname, first name, title, job title, pseudonym, social network pseudonym ;<\/li>\n<li>(ii) Contact details: Telephone, e-mail address, postal address, fax, &#8230; ;<\/li>\n<li>(iii) Photo: when you grant us this right (usually taken during events or interviews at our events);<\/li>\n<li>(iv) Professional life: profession, qualifications, work experience, &#8230; ;<\/li>\n<li>(v) Bank details if required ;<\/li>\n<li>(vi) Personal life and lifestyle habits (e.g. shopping habits, purchasing plans).<\/li>\n<\/ul>\n<p>R\u00e9seau DEF collects and processes the Customer&#8217;s personal data relating to his browsing and behaviour on an Internet site published by R\u00e9seau DEF.<\/p>\n<p>The personal data collected in this context are as follows:<\/p>\n<p>TECHNICAL DATA (according to use)<\/p>\n<ul>\n<li>(i) Identification data (IP)<\/li>\n<li>(ii) Connection data (logs in particular)<\/li>\n<li>(iii) Consent data (click) mainly for access to our services (Sentinel etc.)<\/li>\n<\/ul>\n<p>R\u00e9seau DEF does not process sensitive data within the meaning of Article 9 of the RGPD (personal data revealing racial or ethnic origin, philosophical, political, trade union or religious opinions, sex life or health).<\/p>\n<\/div><\/div><\/div><\/section>\n<section class='av_toggle_section av-ldk91mb7-410e4ecaf866419d4baca918bc395733'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  ><p id='toggle-toggle-id-5' data-fake-id='#toggle-id-5' class='toggler  av-title-above '  itemprop=\"headline\"  role='tab' tabindex='0' aria-controls='toggle-id-5' data-slide-speed=\"200\" data-title=\"Article 5. Purposes of processing<span class=\"toggle_icon\"><span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p><div id='toggle-id-5' aria-labelledby='toggle-toggle-id-5' role='region' class='toggle_wrap  av-title-above'  ><div class='toggle_content invers-color '  itemprop=\"text\" ><p>The purpose of this paragraph is to inform the Customer about the use by DEF Network of data collected directly or indirectly.<\/p>\n<p>The processing of the Customer&#8217;s personal data by R\u00e9seau DEF is necessary to enable it to fulfil the following purposes:<\/p>\n<ul>\n<li>(i) processing ;<\/li>\n<li>(ii) customer relationship management ;<\/li>\n<li>(iii) management of events organized by the DEF Network (conferences, breakfasts, etc.);<\/li>\n<li>(iv) sending newsletters or information feeds;<\/li>\n<li>(v) to improve site navigation;<\/li>\n<li>(vi) answers to questions (by telephone or online) ;<\/li>\n<li>(vii) responses to public or private invitations to tender;<\/li>\n<li>(viii) personalized sales follow-up ;<\/li>\n<li>(ix) improvement of its services ;<\/li>\n<li>(x) meeting our administrative obligations ;<\/li>\n<li>(xi) management of requests to exercise the rights of data subjects as listed in article 8 below.<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/section>\n<section class='av_toggle_section av-ldk92kfz-63f7b0f6b6612f14a51c221f4200d0ee'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  ><p id='toggle-toggle-id-6' data-fake-id='#toggle-id-6' class='toggler  av-title-above '  itemprop=\"headline\"  role='tab' tabindex='0' aria-controls='toggle-id-6' data-slide-speed=\"200\" data-title=\"Article 6. Recipients of personal data<span class=\"toggle_icon\"><span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p><div id='toggle-id-6' aria-labelledby='toggle-toggle-id-6' role='region' class='toggle_wrap  av-title-above'  ><div class='toggle_content invers-color '  itemprop=\"text\" ><p>All personal data collected and processed by R\u00e9seau DEF is strictly confidential.<\/p>\n<p>R\u00e9seau DEF undertakes not to transmit the personal data of its Customers to a third party likely to use them for its own purposes, without their express consent.<\/p>\n<p>R\u00e9seau DEF ensures that data is only accessible to authorized internal or external recipients.<\/p>\n<p><strong>Internal recipients :<\/strong><\/p>\n<ul>\n<li>(i) All DEF Network employees DEF Network internal recipients are trained and authorized to process personal data.<\/li>\n<\/ul>\n<p><strong>External recipients :<\/strong><\/p>\n<ul>\n<li>(i) Service providers or support services (subcontractors, various service providers, etc.)<\/li>\n<li>(ii) Lawyers, experts, agents, bailiffs, etc.<\/li>\n<li>(iii) Legal proceedings<\/li>\n<li>(iv) Administration<\/li>\n<\/ul>\n<p>When the recipient concerned is located outside the European Union, or in a country that does not have adequate regulation within the meaning of the RGPD, R\u00e9seau DEF frames its contractual relationship with this third party by adopting an appropriate contractual arrangement.<\/p>\n<p>It should be emphasized that R\u00e9seau DEF may be required to transmit the personal data of its Customers in response to an injunction from the legal authorities.<\/p>\n<\/div><\/div><\/div><\/section>\n<section class='av_toggle_section av-ldk939br-e1c3b6e4c52193f124df18c82f8e0a62'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  ><p id='toggle-toggle-id-7' data-fake-id='#toggle-id-7' class='toggler  av-title-above '  itemprop=\"headline\"  role='tab' tabindex='0' aria-controls='toggle-id-7' data-slide-speed=\"200\" data-title=\"Article 7. Shelf life<span class=\"toggle_icon\"><span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p><div id='toggle-id-7' aria-labelledby='toggle-toggle-id-7' role='region' class='toggle_wrap  av-title-above'  ><div class='toggle_content invers-color '  itemprop=\"text\" ><p>The customer&#8217;s personal data is kept for a period of three (3) years from the date of collection.<\/p>\n<p>Audience measurement statistics are not kept for longer than thirteen (13) months.<\/p>\n<p>However, at the end of the aforementioned periods, including as necessary from the date of the Customer&#8217;s request for deletion, the Customer&#8217;s personal data may be subject to intermediate archiving so that R\u00e9seau DEF can meet its legal retention obligations:<\/p>\n<ul>\n<li>(i) the contract concluded as part of a commercial relationship will be kept for five (5) years from its conclusion;<\/li>\n<li>(ii) contracts concluded by electronic means for an amount equal to or greater than 120 euros will be kept for two (2) years from their conclusion;<\/li>\n<li>(iii) bank documents will be kept for five (5) years from the date of their communication;<\/li>\n<li>(iv) documents relating to the management of orders will be kept for ten (10) years;<\/li>\n<li>(v) documents relating to billing management will be kept for ten (10) years.<\/li>\n<\/ul>\n<p>Some data may be archived for longer periods than those specified. (i) in the event of contentious proceedings in order to establish the reality of the facts in dispute; and\/or (ii) for the purposes of investigating, ascertaining and prosecuting criminal offences, with the sole aim of making such data available to the judicial authorities where necessary.<\/p>\n<p>Archiving means that this data is anonymized and can no longer be consulted online, but is extracted and stored on an autonomous, secure medium.<\/p>\n<p>Once the time limits set out in the policy have elapsed, the data is deleted.<\/p>\n<\/div><\/div><\/div><\/section>\n<section class='av_toggle_section av-ldk940vm-ae5fb5e5d54640face1af2599a89fa7f'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  ><p id='toggle-toggle-id-8' data-fake-id='#toggle-id-8' class='toggler  av-title-above '  itemprop=\"headline\"  role='tab' tabindex='0' aria-controls='toggle-id-8' data-slide-speed=\"200\" data-title=\"Article 8. Rights of persons concerned<span class=\"toggle_icon\"><span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p><div id='toggle-id-8' aria-labelledby='toggle-toggle-id-8' role='region' class='toggle_wrap  av-title-above'  ><div class='toggle_content invers-color '  itemprop=\"text\" ><p>Customers have a right of access, modification, opposition, limitation, portability, rectification, to define directives concerning the fate of their data after their death and deletion of their personal data, the latter being subject to compliance with the following rules:<\/p>\n<ul>\n<li>(i) the request is made by the individual himself\/herself and is accompanied by a copy of an up-to-date identity document;<\/li>\n<li>(ii) the request must be made in writing to the following address: rgpd@reseau-def.com<\/li>\n<\/ul>\n<p>In accordance with the right to data portability, customers have the right to request a copy of their personal data being processed. The information requested will be provided in electronic form, unless expressly requested otherwise.<\/p>\n<p>Customers are hereby informed that these rights may never relate to confidential information or data, or to data for which communication is not authorized by law. Under no circumstances may these rights allow access to documents subject to the Secret D\u00e9fense.<\/p>\n<p>The right to the deletion of customers&#8217; personal data shall not apply where processing is carried out in order to comply with a legal obligation.<\/p>\n<p>The customer may, at any time, lodge a complaint with the competent supervisory authority.<\/p>\n<\/div><\/div><\/div><\/section>\n<section class='av_toggle_section av-ldk94t3r-d4c28d791cf4b78b260aad10e8d07683'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  ><p id='toggle-toggle-id-9' data-fake-id='#toggle-id-9' class='toggler  av-title-above '  itemprop=\"headline\"  role='tab' tabindex='0' aria-controls='toggle-id-9' data-slide-speed=\"200\" data-title=\"Article 9. Subcontracting<span class=\"toggle_icon\"><span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p><div id='toggle-id-9' aria-labelledby='toggle-toggle-id-9' role='region' class='toggle_wrap  av-title-above'  ><div class='toggle_content invers-color '  itemprop=\"text\" ><p>R\u00e9seau DEF informs its Customers that it may involve any subcontractor of its choice in the processing of their personal data.<\/p>\n<p>The subcontractor refers to any individual or legal entity that processes personal data on behalf of R\u00e9seau DEF.<\/p>\n<p>In this case, DEF Network ensures that the processor complies with its obligations under the RGPD. R\u00e9seau DEF undertakes to sign a written contract with all its subcontractors and to impose the same data protection obligations on subcontractors as it does.
